What is the FDCPA?
Passed by Congress in 1977, the Fair Debt Collection Practices Act (FDCPA) is intended to eliminate abusive creditor harassment and to promote fair consumer credit collections. It provides for a consumer's rights to dispute debts and lays out penalties for collectors who break the law.
When attempting to collect a debt, creditors must always:
- Clearly identify themselves
- Provide name and address of the original creditor
- Verify a debt in writing
- Notify a person of their rights to dispute a debt
- Follow proper legal procedure if filing a lawsuit
They are forbidden to engage in such behavior as contacting you by postcard, calling you outside of certain hours, using profane or deceitful language, continuing to contact you once you have provided a written request for an end to communication, to publish your name and address, or to report false data to credit bureaus. You may even be eligible to receive monetary damages if a collector has violated the FDCPA, causing you undue distress or suffering.
